Information document pursuant to and for the purposes of Article 13, Legislative Decree no. 196 of 30 June 2003

 

PRIVACY POLICY

In compliance with Legislative Decree no. 196 of 30 June 2003 (Privacy Consolidation Act), we hereby provide you with the necessary information regarding the purposes and methods of processing your personal data, as well as the scope of communication and diffusion of the same, the nature of the data and their conferment.

This document, concerning the personal data confidentiality policies of the company TOTEM FOOD SRL, is intended to accurately describe the methods used to manage the processing of the personal data of users and visitors to its site.

 

In order to provide a complete service, our site contains links to other websites. The fact that TOTEM FOOD SRL provides these links does not imply approval of the sites themselves, on whose quality, contents and graphics TOTEM FOOD SRL declines all responsibility. TOTEM FOOD SRL is not responsible for the information obtained by the user through access to the linked sites. Therefore, the owners of the sites accessed are responsible for the completeness and accuracy of the information, according to the conditions envisaged by the sites themselves. TOTEM FOOD SRL does not offer any assurance on the software that may be present on external sites and cannot guarantee its quality, safety when downloading it, or its safety and compatibility with the systems in use.

 

The indications given below are also inspired by Recommendation no. 2/2001 of the Group of European Guarantors for the protection of personal data adopted on 17th May 2001 ex art. 29 of directive no. 95/46/CE, they particularly concern the collection of personal data on the Internet and aim to identify the minimum measures that must be implemented towards the persons concerned in order to guarantee the loyalty and lawfulness of these practices (in application of articles 6, 7, 10 and 11 of directive 95/46/CE). TOTEM FOOD SRL treats users’ personal information with great care. By accessing or using any of the TOTEM FOOD SRL websites, the user expressly accepts the conditions established in this privacy policy. If you disagree with any of the terms of this privacy policy, please do not use the sites or do not provide your personal data. Some services may be conditional on the provision of personal data.

 

When accessing the Site, we can therefore distinguish between data derived from the user’s browsing alone and data voluntarily provided by the user in connection with certain purposes.

 

Type and nature of data processed

 

Personal and/or identification data for the purposes envisaged in this privacy policy, “Personal data” means all the information through which the user can be personally identified, and includes, by way of example but not limited to, name, surname, address, fixed or mobile telephone number, e-mail address, etc. TOTEM FOOD SRL’s privacy policy governs the processing of the user’s personal data, including but not limited to the collection, use, storage and protection of the information provided and/or collected by the user for the purposes indicated below. The processing operations connected to the web services offered by this site are carried out at the headquarters of the company in charge of the processing, and are only handled by employees, collaborators or partners of the company TOTEM FOOD SRL in charge of the processing, or by persons in charge of the processing and occasional managers only for maintenance operations. No data deriving from web services is communicated or disseminated.

 

Data from user navigation

 

The computer systems and software procedures used to operate the Site acquire, during their normal operation, some data whose transmission is implicit in the use of Internet communication protocols.

 

This information is not collected in order to be associated with identified interested parties, but by its very nature could, through processing and association with data held by third parties, allow users to be identified. These data processing and association activities are never carried out by the data controller. This category of data includes IP addresses or the domain names of the computers used by users who connect to the Website, the URI (Uniform Resource Identifier) addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the user’s operating system and computer environment.

 

These data are used exclusively in an anonymous form and for statistical purposes related to the use of the Site and its correct functioning and are deleted immediately after processing. The data could be used and stored in the event of suspected computer crimes to the detriment of the Site, for which the owner reserves the right to appeal to the competent authorities to ascertain any responsibility.

 

Data provided voluntarily by the user

 

The personal data provided by users who voluntarily interact with the Site, giving their personal data for the achievement of certain services (requests for commercial information, subscription to newsletters, sending a curriculum vitae or e-mail messages, etc.), are used only to perform the service or provision requested and are communicated to third parties only where this is strictly necessary for the performance of the service (shipment of material, provision of assistance, etc.).

 

Specific summarised information is reported or displayed on the pages of the Site set up for services on request, so as to draw the attention of the person concerned to the processing of their personal data.

 

Apart from what has been specified above for surfing data, the provision of users’ personal data is optional, even though it is functional to the provision of certain services; in these cases, therefore, failure to provide data could compromise or make it impossible to provide the service.

 

Cookies

 

The software applications used may contain “cookie” technology. Cookies mainly have the function of facilitating navigation by the user. Cookies can provide information on navigation within the Site and allow the operation of certain services that require identification of the user’s path through different pages of the Site. The cookies present in the software applications used are anonymous and cannot be traced back to the user’s personal data. For any access to the portal, regardless of the presence of a cookie, the type of browser (e.g. Internet Explorer, Netscape), the operating system (e.g. Macintosh, Windows), the host and the URL of origin of the visitor, as well as the data on the page requested, are recorded. However, the user has the option of setting his or her browser to be informed when a cookie is received and thus deciding to delete it. Types of cookies

 

“Session” and “persistent” cookies, the former once downloaded are then deleted when the browser is closed, the latter are stored on the user/visitor’s hard drive until they expire. Persistent cookies are mainly used to facilitate site navigation, to understand which sections of the site have generated a certain number of pages and users and also for the delivery of advertising formats. The purpose of the session cookies used is to speed up the analysis of Internet traffic and make it easier for users to access the services offered by the site; no personal data is transmitted or acquired through their use and no user tracking systems are used. Session cookies are mainly used during authentication, authorisation and navigation in the services that are accessed through a registration”. This software, used for the site and platform, creates one cookie per user in order to generate usage statistics. The data generated by this cookie is stored by Google Inc. Purposes of the processing for which consent is granted where required (art. 23 Legislative Decree 196/03)

 

Management of data processing (company, name, surname, e-mail address, telephone numbers and address) voluntarily provided by you, concerning:

 

Requests for information concerning the services of TOTEM FOOD SRL and to be contacted by the same company;

Acquisition of information prior to the conclusion of a contract, supply of services and commercial offers.

Processing methods – Storage

 

The processing shall be carried out automatically and manually, using methods and tools that guarantee maximum security and confidentiality, by persons specifically appointed for this purpose in compliance with the provisions of articles 31 et seq. Legislative Decree 196/03. The data will be kept for a period not exceeding the purposes for which the data were collected and subsequently processed.

 

Area of communication and diffusion

 

Your data, the object of the processing, shall not be disclosed – unless explicitly authorised by means of suitable information – it may instead be communicated to companies contractually bound to TOTEM FOOD SRL abroad within the European Union, in compliance with and within the limits envisaged by art. 42 of Legislative Decree no. 196/2003. Personal data may be transferred abroad to non-EU countries within the scope and limits envisaged by art. 43 and art. 44 letter b) of Legislative Decree no. 196/2003 in order to fulfil contracts or related purposes. The data may be communicated in this sense to third parties belonging to the following categories:

 

subjects providing services for the management of the information system used by TOTEM FOOD SRL and the telecommunications networks (including e-mail and website management);

subjects and bodies that collaborate with TOTEM FOOD SRL to carry out the services you have requested

service companies for the acquisition, registration and processing of data coming from documents or supports supplied and originated by the customers themselves and concerning massive processing of payments, bills, cheques and other securities;

parties that provide assistance to users

professionals, firms or companies in the context of assistance and consultancy relationships;

competent authorities for the fulfilment of legal obligations and/or provisions of public bodies, upon request.

The subjects belonging to the above categories act as Data Processors, or operate completely independently as separate Data Controllers. The list of data processors is constantly updated and available at the offices of TOTEM FOOD SRL. Any further communication or dissemination shall take place only with your explicit consent.

 

Nature of provision and refusal

 

Providing the data marked with a * symbol is necessary. Failure to do so may make it impossible for TOTEM FOOD SRL to contact you. Apart from what has been specified for navigation data, the user is free to provide personal data to request information material or to request other types of services offered by the Company. You may assert your rights as expressed in Articles 7, 8, 9 and 10 of Legislative Decree no. 196 of 30 June 2003, by contacting the Data Controller, our Company, in the person of its legal representative or the data processor, indicated below, whom you may contact by contacting our head office at the telephone number +39 080 768612, or by sending an email to office@totemfood.com

Article 7. Right of access to personal data and other rights

 

1.You have the right to obtain confirmation as to whether or not personal data concerning you exists, even if it has not yet been recorded, and communication of such data in intelligible form.

  1. You have the right to be informed of: a) the source of the personal data; b) the purposes and methods of processing; c) the logic applied to the processing, if the latter is carried out with the help of electronic means; d) the identification data concerning data controller, data processors and the representative designated as per Section 5(2); e) the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing. 3. The interested party has the right to obtain a) the updating, rectification or, when interested, the integration of data; b) the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including data whose retention is unnecessary for the purposes for which the data were collected or subsequently processed; c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected. 4. The data subject shall have the right to object, in whole or in part, a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection; b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.

 

Changes to the Privacy Policy

 

The controller reserves the right to change, update, add or remove parts of this privacy policy at its own discretion and at any time. The data subject should periodically check this page for any changes. In order to facilitate this verification, the privacy policy will contain an indication of the date of publication on the website. The use of the site after the publication of the changes will constitute acceptance of the same.
